These Terms & Conditions and Privacy Policy (“Terms”) govern your use of the services of Escapes by Escala LLC (“Company,” “we,” “our,” or “us”) and our website, escapesbyescala.com (“Site”). By using our Site or engaging our services, you agree to be bound by these Terms.

1. Role of Escapes by Escala

Escapes by Escala acts solely as a travel advisor and booking agent for independent third-party suppliers, including but not limited to airlines, hotels, cruise lines, tour operators, and ground transportation providers (“Suppliers”). We do not own, operate, or control these Suppliers and are not responsible for their acts, omissions, delays, insolvency, or failure to perform.

All travel services are subject to the terms, conditions, and liability limits imposed by the applicable Suppliers.

2. No Guarantee of Pricing or Availability

Travel pricing, availability, inventory, and amenities are not guaranteed until confirmed and ticketed by the applicable Supplier. Prices and availability may change due to Supplier policies, demand, currency fluctuations, or delayed client responses. Escapes by Escala is not responsible for price increases or lost availability.

3. Website Use

The content on our Site is provided for general informational purposes only and does not constitute guarantees, professional advice, or endorsements.

Our Site may include links to third-party websites. We are not responsible for the content, accuracy, privacy practices, or policies of those external sites.

You agree to use our Site only for lawful purposes and not to engage in any activity that could damage, disable, disrupt, or impair the Site.

4. Privacy Policy
Information We Collect

We may collect personal information necessary to provide travel services, including but not limited to:

  • Name, email address, phone number, billing address

  • Passport, visa, or government ID details

  • Payment information when required for bookings

  • Information voluntarily submitted through inquiries, forms, or feedback

  • Technical data such as IP address, browser type, and cookies

How We Use Your Information

We use your information to:

  • Provide travel planning and booking services

  • Communicate regarding itineraries, confirmations, and inquiries

  • Improve our services and website functionality

  • Comply with legal, administrative, or security requirements

Data Sharing

We share personal information only with Suppliers and service providers as necessary to complete travel arrangements. We do not sell or rent personal information to third parties. We may disclose information when required by law or legal process.

Data Retention & International Transfers

We retain personal information only as long as necessary to provide services, comply with legal obligations, or resolve disputes. Your information may be transferred to and processed in countries outside your jurisdiction as required to arrange travel.

Your Rights

You may request access to, correction of, or deletion of your personal information by contacting michelle@escapesbyescala.com. Depending on your jurisdiction (including GDPR or CCPA), additional rights may apply.

Data Security

We use commercially reasonable safeguards to protect personal data; however, no system is completely secure, and we cannot guarantee absolute security.

5. Cookies & Tracking Technologies

Our Site may use cookies and similar technologies (including Google Analytics and Meta pixels) to analyze traffic, personalize content, and improve performance. By continuing to use our Site, you consent to the use of cookies. You may disable cookies in your browser, though some features may not function properly.

6. Payments, Fees, Cancellations & Chargebacks

All Supplier deposits and final payments are non-refundable unless otherwise stated by the Supplier.

Professional planning and service fees charged by Escapes by Escala are earned upon receipt and non-refundable, regardless of whether travel is ultimately booked.

Client-initiated cancellations or rescheduling may incur a $500 service fee, in addition to any Supplier penalties or fare differences.

Accepted payment methods may include credit cards, and by prior arrangement, checks, ACH, or wire transfers. Clients are responsible for all bank fees, foreign transaction fees, or processing charges.

Clients agree not to initiate chargebacks or payment disputes for services rendered, except in cases of verifiable fraud. Improper chargebacks may result in recovery of associated costs.

7. Client Conduct

Clients agree to conduct themselves respectfully and lawfully with Suppliers, guides, staff, and other travelers. Disruptive, unsafe, or unlawful behavior may result in denied services without refund or liability to Escapes by Escala or the Supplier.

8. Passports, Visas & Travel Documents

Clients are solely responsible for obtaining and carrying valid passports, visas, health certificates, and required documentation. Passports must generally be valid for at least six (6) months beyond the return date. Entry requirements vary by destination and may change without notice.

Clients are responsible for providing accurate personal information, including full legal names exactly as they appear on government-issued identification. Escapes by Escala is not responsible for errors resulting from incorrect or incomplete information provided by the client.

9. Travel Insurance

We strongly recommend comprehensive travel insurance covering cancellation, interruption, medical expenses, and other unforeseen events. Clients who decline insurance assume full financial responsibility for any losses, disruptions, or additional costs.

10. Testimonials & Marketing

Unless you opt out in writing prior to publication, you grant Escapes by Escala permission to use non-sensitive, non-identifying testimonials, reviews, or travel photos you voluntarily provide for marketing purposes. We do not publish sensitive personal information without consent.

11. Limitation of Liability

Escapes by Escala’s total liability is strictly limited to the professional planning fees paid directly to us.

We are not liable for losses, damages, injuries, delays, or expenses arising from Supplier acts or omissions, government actions, weather, pandemics, or other events beyond our control. We do not accept liability for indirect, incidental, or consequential damages.

12. Force Majeure

We are not responsible for failure to perform due to events beyond our reasonable control, including but not limited to natural disasters, pandemics, labor disputes, acts of terrorism, or government restrictions.

13. Dispute Resolution & Governing Law

These Terms are governed by the laws of the State of Idaho. Any dispute arising out of or relating to these Terms or services will be resolved through binding arbitration in Kootenai County, Idaho, except that either party may bring an individual claim in small claims court where permitted by law.

All claims must be brought on an individual basis and not as part of any class or representative action.

14. Entire Agreement & Hierarchy

These Terms & Conditions and Privacy Policy, together with any separately executed Travel Advisor Agreement, constitute the entire agreement between you and Escapes by Escala. In the event of a conflict, the signed Travel Advisor Agreement shall control.
