These Terms & Conditions and Privacy Policy govern the use of the services of Escapes by Escala LLC (“Company,” “we,” “our,” or “us”) as well as use of our website, escapesbyescala.com (“Site”). By using our services or our Site, you agree to be bound by these Terms.

1. Role of Escapes by Escala

We act solely as an agent in arranging travel services provided by independent suppliers, including but not limited to airlines, hotels, tour operators, and cruise lines (“Suppliers”). We do not own, operate, or control these Suppliers and are not responsible for their acts or omissions. All travel services are subject to the terms, conditions, and liability limits imposed by the Suppliers.

2. Website Use

  • The content on our Site is provided for general informational purposes only and does not constitute guarantees, professional advice, or endorsements.

  • We may include links to third-party websites. We are not responsible for the content, privacy practices, or policies of those external sites.

  • You agree to use our Site only for lawful purposes and not to engage in activity that could damage, disable, or impair the Site.

3. Privacy Policy

We are committed to protecting your privacy and the personal information you share with us.

Information We Collect

  • Personal details (name, email, phone number, billing address, passport/ID information, etc.) necessary to arrange travel.

  • Payment details when required to process bookings.

  • Information voluntarily provided through forms, inquiries, or feedback.

  • Technical data such as cookies, IP address, and browser information when you use our Site.

How We Use Your Information

  • To provide travel planning and booking services.

  • To communicate about your travel, respond to inquiries, and send confirmations.

  • To improve our Site, services, and client experience.

  • For administrative, legal, or security purposes.

Data Sharing

  • We share your information only with Suppliers as required to complete bookings (e.g., airlines, hotels, tour operators).

  • We do not sell or rent your personal information to third parties.

  • We may disclose information when required by law or in response to legal process.

4. Cookies

5. Payments, Deposits, Cancellations, Refunds

  • All deposits and final payments are non-refundable unless otherwise stated by the Supplier.

  • Our professional planning and service fees are non-refundable.

  • Cancellation or rescheduling by the client will incur a service fee of $500, in addition to any Supplier penalties.

  • Payment Methods: We accept credit cards, and may accept checks, wire transfers, or ACH transfers by prior arrangement. Additional fees or processing time may apply.

  • Clients are responsible for any bank fees, chargebacks, or disputed payments.

6. Client Conduct

Clients agree to conduct themselves respectfully with Suppliers, guides, staff, and other travelers. Disruptive, unlawful, or unsafe behavior may result in denied service, without refund or liability to Escapes by Escala or the Suppliers.

7. Passports, Visas & Travel Documents

  • Clients are responsible for obtaining and carrying all necessary passports, visas, health certificates, and other required documents.

  • Passports must be valid for at least six (6) months beyond the return travel date.

  • Entry requirements vary by destination and may change without notice.

8. Travel Insurance

We strongly recommend purchasing comprehensive travel insurance to cover cancellation, trip interruption, medical expenses, baggage, and other unforeseen events. Clients who decline insurance assume full responsibility for any losses.

9. Testimonials & Marketing

Unless otherwise requested in writing, you grant Escapes by Escala permission to use anonymized feedback, reviews, or photographs you voluntarily provide for marketing purposes. We will not publish identifying information without explicit consent.

10. Limitation of Liability

  • Escapes by Escala’s liability is strictly limited to the professional planning fees paid directly to us.

  • We are not liable for losses, damages, injuries, or expenses arising from acts or omissions of Suppliers, government authorities, or events beyond our control.

  • We do not accept liability for indirect, incidental, or consequential damages.

11. Force Majeure

We are not responsible for failure to perform our obligations in circumstances beyond our reasonable control, including but not limited to natural disasters, pandemics, strikes, acts of terrorism, or government restrictions.

12. Dispute Resolution & Governing Law

These Terms are governed by the laws of the State of Idaho. Any disputes shall be resolved through binding arbitration in Kootenai County, Idaho, and judgment on the arbitration award may be entered in any court of competent jurisdiction.

13. Entire Agreement

These Terms & Conditions and Privacy Policy, together with any signed client agreements, constitute the entire agreement between you and Escapes by Escala.
